These Terms of Service govern the use of ConstructionHands.com and all related services.

1. ACCEPTANCE OF TERMS

By accessing or using ConstructionHands.com (“Site”, “Service”, “Platform”), operated by Construction Jobs, Inc., a Texas C-Corporation doing business as ConstructionHands.com (“Company”, “we”, “us”, “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. USER CONTENT RIGHTS AND LICENSES

2.1 Job Postings

By posting job listings on ConstructionHands.com, employers grant Construction Jobs, Inc. a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to:

  • Display, distribute, and promote job postings on the Platform
  • Share job postings with registered candidates
  • Use job posting data for analytics and platform improvement
  • Include job postings in search engine results and site maps
  • Share job postings on social media and partner platforms
  • Modify job posting format for display purposes
  • Archive job postings for historical reference

2.2 Resumes and Candidate Profiles

By uploading resumes or creating candidate profiles, job seekers grant Construction Jobs, Inc. a non-exclusive, worldwide, royalty-free license to:

  • Display resumes and profiles to registered employers
  • Include profiles in employer search results
  • Use profile data for job matching algorithms
  • Send profile information to employers upon candidate application
  • Generate anonymous analytics and market insights
  • Store resumes for candidate dashboard access

IMPORTANT: Job seekers retain full ownership and copyright of their resume content. The Company will not sell, rent, or provide resume information to third parties except as necessary to facilitate job matching on the Platform.

2.3 User Communications

Messages, communications, and interactions conducted through the Platform remain private between users. The Company does not claim ownership of user communications but reserves the right to monitor for Terms compliance.

3. COMPANY INTELLECTUAL PROPERTY RIGHTS

3.1 Protected Materials

The following materials are the exclusive property of Construction Jobs, Inc. and are protected by copyright, trademark, patent, and other intellectual property laws:

  • ConstructionHands name, logo, and branding
  • Website design, layout, and user interface
  • Custom software, plugins, and code
  • Database structure and compilation
  • Matching algorithms and classification systems
  • Trade secrets and proprietary business methods
  • Marketing materials and content
  • Documentation and user guides

3.2 Trademark Notice

CONSTRUCTIONHANDS and the ConstructionHands logo are trademarks of Construction Jobs, Inc. Unauthorized use of these trademarks is prohibited and may violate trademark laws.

3.3 Copyright Notice

4. PROHIBITED USES

Users are expressly prohibited from:

  • Posting false, misleading, or fraudulent job listings or resumes
  • Scraping, crawling, or extracting data from the Platform using automated means
  • Creating multiple accounts to circumvent restrictions
  • Posting discriminatory job listings or content
  • Harassing, threatening, or abusing other users
  • Spamming users with unsolicited communications
  • Using the Platform for any illegal purpose
  • Attempting to gain unauthorized access to Platform systems
  • Interfering with Platform operations or security
  • Removing copyright or trademark notices
  • Reverse engineering Platform software or algorithms
  • Reselling or redistributing Platform services
  • Posting jobs for illegal activities or scams
  • Misrepresenting employment opportunities
  • Collecting user information without consent
  • Using the Platform to compete with the Company

5. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • NO WARRANTY OF MERCHANTABILITY
  • NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE
  • NO WARRANTY OF NON-INFRINGEMENT
  • NO WARRANTY OF ACCURACY OR COMPLETENESS OF CONTENT
  • NO WARRANTY OF UNINTERRUPTED OR ERROR-FREE SERVICE
  • NO WARRANTY REGARDING JOB LISTING AUTHENTICITY
  • NO WARRANTY OF RESUME QUALITY OR CANDIDATE QUALIFICATIONS
  • NO WARRANTY OF SUCCESSFUL JOB PLACEMENT OR HIRING

The Company does not warrant, endorse, guarantee, or assume responsibility for any job listing, resume, user, or third-party product or service advertised or offered on the Platform. The Company is not a party to or in any way responsible for any transaction between employers and job seekers.

USERS ACKNOWLEDGE THAT CONSTRUCTION JOBS, INC. IS A PLATFORM PROVIDER ONLY AND DOES NOT EMPLOY, RECOMMEND, OR ENDORSE ANY USER OR JOB LISTING. ALL EMPLOYMENT RELATIONSHIPS ARE DIRECTLY BETWEEN EMPLOYERS AND CANDIDATES.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSTRUCTION JOBS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
  • ANY PERSONAL INJURY OR PROPERTY DAMAGE
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR PERSONAL INFORMATION
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE PLATFORM
  • ANY BUGS, VIRUSES, OR MALICIOUS CODE TRANSMITTED THROUGH THE PLATFORM
  • ANY ERRORS OR OMISSIONS IN CONTENT OR FOR ANY LOSS INCURRED BY USE OF CONTENT
  • ANY CONDUCT OR ACTIONS OF THIRD PARTIES OR OTHER USERS
  • ANY EMPLOYMENT DISPUTES BETWEEN EMPLOYERS AND CANDIDATES
  • ANY FAILURE TO SECURE EMPLOYMENT OR FILL POSITIONS

IN NO EVENT SHALL THE TOTAL LIABILITY OF CONSTRUCTION JOBS, INC. TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO CONSTRUCTION JOBS, INC., IF ANY, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Construction Jobs, Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you post on the Platform
  • Your employment decisions or hiring practices
  • Any false or misleading information you provide
  • Your communications with other users

8. FREE SERVICE DISCLAIMER

ConstructionHands.com is currently provided free of charge to users. The Company reserves the right to introduce fees or subscription models in the future with advance notice. Free accounts may have limitations compared to paid accounts if and when paid tiers are introduced.

9. ACCOUNT TERMINATION

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without cause, with or without notice, for any reason including but not limited to:

  • Violation of these Terms of Service
  • Fraudulent, false, or misleading content
  • Abusive or harassing behavior
  • Suspected illegal activity
  • Non-payment of fees (if applicable)
  • At our sole discretion

10. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Texas, and you consent to personal jurisdiction and venue in such courts.

11. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or by posting a notice on the Site. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
